This update is to alert all as to the ongoing Corporate Transparency Act (“CTA”) seeking enforcement for non-compliance with same. It has been publicized on December 3, 2024 (within the Texas Top Cop Shop, Inc., et al. vs. Garland, et al. matter) that the U.S. District Court for the Eastern District of Texas had granted a “…nationwide preliminary injunction…” that appears to temporarily enjoin any and all enforcement of said CTA. It has also been set forth that certain guidance from FinCEN, which is the ongoing regulatory agency as to enforcement of the CTA, is also expected to be issued soon. The court opinion again temporarily sets for prevention of any enforcement after the January 1, 2025 deadline as to the reporting companies as filing reports. Please contact your professional advisors (CPA, attorney, etc.) as to how to move forward for the CTA filing now and should said injunction be reversed, revised or simply lifted.
