New Jersey Residential Landlords: All is Not Lost

Governor Phil Murphy’s Executive Order 106 suspended nearly all residential evictions throughout the State of New Jersey; however, the Governor’s temporary eviction moratorium does not mean landlords have no recourse for unpaying tenants.  The Executive Order specifically provides that it “does not affect any schedule of rent that is due” and that a Court may proceed with an eviction when “enforcement is necessary in the interest of justice.”  While the adage “bad things happen to good people” remains true and we always encourage landlords and tenants work together to resolve any payment disputes, all is not lost for New Jersey landlords.  When non-paying tenants take advantage of the Governor’s Executive Order by withholding their rent for reasons beyond the genuine economic hardship caused by the COVID-19 pandemic, enforcement may become necessary “in the interest of justice.”
